Standard Terms And Conditions – Vehicle Rental Agreement

Carvista Car Rental L.L.C, hereinafter referred to as the “Owner”, rents the vehicle mentioned overleaf to the “Renter” subject to the following terms and conditions stated overleaf and herein.

Renter undertakings:

1. Vehicle condition

  • The renter confirms that the vehicle has been received in good condition except for damages recorded at the time of vehicle checkout and agrees to return the vehicle in the same condition.

2. Fines, tolls, parking & liabilities

  • The renter is responsible for all traffic fines, Salik/Darb (toll) charges, parking fees, damages, accidents, violations, and liabilities incurred during the rental period.

3. Fine handling & admin fees

  • In case of any fine issued by Police or other competent authorities during the rental period, Carvista Car Rental L.L.C is authorized to charge the fine amount along with an administrative fee of AED 50 per fine to the renter’s credit/debit card mentioned below.
  • An administrative fee of AED 1 per Salik/Darb crossing shall apply.
  • These charges are subject to change in line with government regulations, toll authority revisions, or applicable laws, and any revised charges shall be applicable as notified.

4. Accidents & police report

  • In case of accident, the renter must inform the Owner immediately and obtain a valid Police Report.
  • Failure to do so may result in full liability for damages.

5. Vehicles from partner/affiliate companies

  • In the ordinary course of business, the Owner may provide vehicles owned, leased, or registered under affiliated or partner car rental companies.
  • In such cases, the vehicle may be registered in the name of a partner company; however, this rental agreement and all terms and conditions herein shall remain fully applicable and binding on the renter.
  • The Owner shall remain the primary contracting party with the renter, and the renter agrees that the source or ownership of the vehicle shall not affect the applicability or enforceability of this agreement.

6. Personal belongings

  • The Owner shall not be responsible for any loss, theft, or damage to personal belongings left inside the vehicle at any time, including during recovery, towing, servicing, or repossession.

7. Documents validity

  • The renter confirms that all documents provided (Emirates ID/passport/visa/driving license) are valid and genuine.
  • Any liability, fines, seizure, or loss arising due to expired, invalid, or fraudulent documents shall be borne by the renter.

8. Severability

  • If any provision of this agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. Rental charges & extensions

  • To pay all rental charges mentioned overleaf in advance and accepts that rental charges may be subject to change due to reasons beyond the Owner’s control.
  • All dues must be cleared at the time of signing this agreement any rental extension charges must be cleared before the rental expiry date.
  • By taking possession of the vehicle, the renter confirms that the vehicle is in good condition except for damages recorded at the time of vehicle checkout.

10. Pickup & delivery charges

  • Standard pickup and delivery charge each way are AED 150 within Dubai, AED 200 for Sharjah/Ajman, and AED 350 for other Emirates (or as agreed overleaf).
  • Pickup and delivery are subject to availability; any extension due to unavailability of slots shall be borne by the Renter, and until the vehicle is returned, all liabilities shall remain with the Renter.

11. Driver age & license rules

  • The minimum driver age is 25 years and the driving license must be valid and at least 12 months.
  • In cases where the driver is below 25 years of age or the license is less than 12 months old, an additional 20% of the claim amount shall be charged on top of standard insurance excess amount of 1500 AED.
  • Only drivers named in this agreement are permitted to drive the vehicle; additional drivers must be added in advance upon payment of applicable fees of AED 200 or as agreed.
  • No insurance claim shall be valid in case of non-compliance with this clause.

12. Insurance excess & accident process

  • The Renter shall immediately inform the Owner in case of any accident and obtain a valid Police Report to process an insurance claim.
  • A minimum insurance excess of AED 1500 (or as agreed overleaf) shall be payable prior to vehicle repair in cases of renter fault, hit and run, no third party identified, or vehicle total loss.
  • If a Police Report is not provided or if insurance or workshop rejects the claim for any reason, the Renter shall bear the entire cost of damages including third-party liability and any additional charges imposed.
  • In the event of an accident, a replacement vehicle of the same or lower category may be provided subject to availability, and additional charges shall apply in cases of renter fault or liability.
  • The renter shall continue to pay rental charges during the repair period where the accident is caused by renter fault or liability.

13. Damage reporting & penalties

  • Any damage to the vehicle must be reported immediately to the Owner.
  • The Renter is not permitted to repair the vehicle independently; any unauthorized repairs shall constitute breach of contract and the Renter shall be liable to pay full damage costs plus an additional penalty ranging from AED 500 to AED 5000 depending on vehicle and damage severity.
  • The Renter shall pay for all damage not considered normal wear and tear; tire punctures, rim damage, suspension damage, wheel alignment issues, underbody damage, and damage resulting from punctures or impact with kerbs or potholes are excluded from normal wear and tear.
  • Damage caused by natural calamities shall also be borne by the Renter if no valid Police Report is provided or if insurance rejects the claim for any reason.
  • Any mechanical or engine damage caused due to overheating, ignoring warning lights, continued driving despite alerts, low fluids, misuse, or negligence shall be treated as renter negligence and shall be fully chargeable irrespective of insurance.
  • Owner reserves the right to recover loss of revenue for the period the vehicle remains unavailable due to accident, damage, repair, or negligence caused by the renter.
  • Repair and damage costs assessed by the Owner or its authorized workshop shall be final and binding on the renter.

14. Prohibited use

  • The Renter shall not use the vehicle under the influence of alcohol, drugs, or intoxicants; for any illegal or criminal activity; for transporting contraband; outside the UAE without written NOC; through water or in still water; for desert driving, off-roading, towing, racing, rallying, or any activity likely to damage the vehicle or not allowed by any government authority.
  • No insurance claim shall be valid in such cases.
  • The vehicle must be brought to the Owner location for service, maintenance, registration renewal or whenever requested by the Owner.

15. Deposit, fines, black points & disputes

  • A security deposit of AED 1500 (or as agreed overleaf) shall be retained for a minimum of 21 working days after agreement closure and shall not be adjusted against dues at the time of closing.
  • Original receipt must be produced for refund.
  • The Renter has to pay all traffic fines, Salik charges, black points charges, and penalties immediately.
  • The Owner may settle fines without prior notice and is not obligated to provide supporting evidence.
  • Disputes regarding fines shall be handled by the Renter directly with authorities and must be cleared within 24 hours.
  • AED 300 shall be charged per black point to clear the fines with black points.
  • In case of impound-related fines, the Renter has to pay the fine and impound is not permitted.
  • The renter shall not withhold, deduct, or set off any payments against disputed claims, damages, fines, or charges.

16. Fuel, cleanliness, smoking/pets & keys

  • The vehicle must be returned with the same fuel level as at checkout, failing which fuel shall be charged at 1.5 times the actual cost.
  • The vehicle must be returned clean; an AED 100 cleaning fee applies if dirty and AED 300 shampooing fee if excessively dirty.
  • Smoking, eating, or carrying pets inside the vehicle shall attract a minimum penalty of AED 1000 as determined solely by the Owner’s inspection staff.
  • Any interior damage including but not limited to burns, stains, odors, tears, scratches, electronic or infotainment damage, seat damage, or dashboard damage shall be chargeable in addition to cleaning or penalty charges.
  • Loss of registration card shall incur AED 500 charge.
  • Key lost costs range from AED 1500 to AED 10,000 depending on vehicle make; unlocking service charges apply at AED 250 within Dubai and AED 500 outside Dubai and is subject to availability only in working hours.
  • Replacement key costs are non-refundable even if the original key is later found.
  • Keychain loss or damage shall be charged at AED 100.

17. Inspection & temporary replacement vehicle

  • The Renter is responsible for inspecting the vehicle at checkout and marking all damages, mileage, and fuel levels.
  • Initial inspection shall be conducted at return and a comprehensive inspection within three working days.
  • Temporary replacement vehicles provided for service, repair, or renewal may be of same or lower category and shall remain under Renter’s responsibility.

18. Emergency & roadside assistance

  • For any emergency or roadside assistance, the renter shall contact the primary point of contact.
  • In case of situations outside working hours or if the assigned executive is unavailable for any reason, it shall be the renter’s responsibility to take reasonable care of the vehicle and keep it in a safe location.
  • If the vehicle is involved in an accident and is drivable, the renter may drive the vehicle to a safe place and wait for assistance.
  • If the vehicle is not drivable, the renter may arrange recovery and towing to a safe parking location or residence, and all related arrangements and costs shall be borne by the renter unless otherwise agreed by the Owner.

19. Government fees & regulatory changes

  • Any new fees, charges, rules, requirements, or increases imposed by the Government of the United Arab Emirates or any competent authority, including but not limited to toll charges, parking fees, fines, or regulatory levies, shall be applicable to the renter and payable as required, and the Owner shall not be held liable for such changes.

20. Termination, repossession & early termination

  • The Owner reserves the right to terminate this agreement and repossess the vehicle at the Renter’s expense in case of non-payment, misuse, or breach of terms.
  • Owner shall provide maximum 2 hours’ notice by email, call, or WhatsApp before taking possession of the vehicle and may use a spare key for recovery.
  • The renter is requested not to keep valuables inside the vehicle at any time, and the Owner or its staff shall not be responsible for loss of any items during repossession.
  • Failure by the Owner to enforce any term of this agreement shall not be deemed a waiver of such rights.
  • Early termination by the Renter shall attract early termination charges as of 2 months rental or as agreed.

21. Non-return / unreachable renter

  • If the renter becomes unreachable, absconds, or fails to return the vehicle, the Owner may report the vehicle as missing, initiate recovery and legal action, and all associated costs shall be borne by the renter.
  • The contact details mentioned in the rental agreement shall be considered the primary contact details, and any change must be informed to the Owner in writing.

22. Return time, weekends/holidays & refunds

  • The vehicle must be returned by 16:00 on a working day irrespective of checkout time; failure to do so will result in automatic extension until the next working day.
  • Returns or pickups falling on weekends, public holidays, or holidays declared by company due to weather or other conditions shall be automatically extended.
  • Any approved refund shall be issued as a credit note valid for six months; cash refunds are not permitted.

23. Entire agreement & binding statements

  • The renter confirms that he/she has read, understood, and agreed to all terms and conditions mentioned in this agreement and has no doubts or confusion regarding the same.
  • This agreement constitutes the entire understanding between the parties and supersedes all prior discussions, representations, promises, or commitments whether oral or written.
  • No statement or assurance made by any employee, executive, or representative of the Owner shall be binding unless expressly mentioned in this agreement or confirmed through an official company email.

24. Governing law & jurisdiction

  • This agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates, and the courts of the relevant Emirate shall have exclusive jurisdiction.
